Welcome to dEssence. These Terms of Service ("Terms") govern your access to and use of the dEssence browser extension, web application, and related services (collectively, the "Service") provided by dEssence ("we", "us", or "our"). By using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this requirement and have the legal capacity to enter into these Terms.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at support@dessence.ai if you suspect unauthorized use of your account.

3. Use of the Service

You may use the Service only in compliance with these Terms and all applicable laws. You agree not to:

  • Use the Service for any illegal, harmful, or fraudulent purpose
  • Attempt to reverse-engineer, decompile, or otherwise extract the source code of the Service
  • Upload or save content that infringes on intellectual property rights or violates any third-party rights
  • Use automated means (bots, scrapers) to access the Service without our prior written consent
  • Interfere with or disrupt the integrity, security, or performance of the Service
  • Attempt to gain unauthorized access to other users' accounts or our systems

4. Your Content

You retain ownership of all content you save to dEssence ("Your Content"). By using the Service, you grant us a limited, non-exclusive, worldwide license to store, process, and display Your Content solely for the purpose of providing the Service to you, including powering the AI chat and personalization features.

You are solely responsible for Your Content and represent that you have the necessary rights to save and use it within the Service.

5. AI Features

The Service includes AI-powered features that generate responses based on Your Content and conversations. AI-generated output may contain inaccuracies or errors. You should not rely on AI outputs for legal, medical, financial, or other critical decisions without independent verification.

6. Subscription and Payments

Some features of the Service may require a paid subscription. Pricing, billing cycles, and payment terms will be disclosed at the point of purchase. Subscriptions renew automatically unless canceled before the renewal date. Refunds are handled at our discretion and in accordance with applicable law.

7. Intellectual Property

The Service, including its software, design, branding, and trademarks, is owned by dEssence and protected by copyright and other intellectual property laws. These Terms do not grant you any rights to our trademarks or service marks.

8. Third-Party Services

The Service may integrate with or link to third-party services (e.g., analytics providers, AI model providers). We are not responsible for the content, policies, or practices of third-party services.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access to the Service at our discretion, including for violations of these Terms. Upon termination, your right to use the Service will cease immediately.

10. Disclaimers

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, dEssence and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising from your use of or inability to use the Service.

12. Indemnification

You agree to indemnify and hold harmless dEssence, its affiliates, and their respective officers, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms with a new "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable laws, without regard to conflict of laws principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration or in the courts of competent jurisdiction.
